Terms of Use

These Terms of Use (“Terms”) govern your use of the AutoMalaya OBD mobile application, website, and related services (collectively, the “Service”), operated by the AutoMalaya OBD team (“we”, “us”, “our”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is — and is not
The Service reads standard OBD-II diagnostic data from a compatible third-party adapter and presents plain-language explanations, an indicative health score, estimated repair-cost ranges, and shareable reports. The Service provides informational assistance only. It is not a professional mechanical inspection, not a guarantee of a vehicle’s condition or safety, and not a substitute for diagnosis or repair by a qualified technician.
2. No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that diagnostic data, explanations, scores, or cost estimates are accurate, complete, current, or applicable to your specific vehicle, or that the Service will be uninterrupted or error-free. Vehicle support depends on the vehicle, its electronic systems, and the adapter used.
3. Assumption of risk & your responsibilities
- You are solely responsible for all decisions about operating, repairing, buying, selling, or continuing to drive a vehicle.
- Never operate the app while driving. Park safely before reviewing detailed information.
- A warning light, fault code, or score may indicate a serious or unsafe condition. When in doubt, stop driving and consult a qualified technician.
- Repair-cost figures are broad estimates for general guidance only and are not quotations.
- You are responsible for using a compatible, safe OBD-II adapter and following its manufacturer’s instructions.
4. Permitted use & prohibited conduct
The Service reads standard OBD-II data only. It does not provide, and you may not use it to attempt, ECU flashing or reprogramming, firmware/file dumping, immobilizer or key coding, odometer alteration, emissions-control defeat, security bypass, or any manufacturer-restricted or unlawful function. You agree not to misuse the Service, reverse engineer it (except as permitted by law), or use it in any unlawful manner.
5. Third-party hardware & services
OBD-II adapters and other hardware are made by third parties and are not supplied or warranted by us. App purchases are processed by Apple under Apple’s terms. We are not responsible for third-party products, services, or content.
6. Purchases & payments
AutoMalaya Pro and the used-car inspection report are optional one-time purchases billed through your Apple Account — there is no subscription and nothing auto-renews. You can restore purchases on a new device. Except where required by applicable law, payments are non-refundable, and prices may change with notice. (Any future workshop/business plan that is offered on a recurring basis will state its renewal terms clearly before purchase.)
7. Used-car inspections
Inspection reports describe only what was observed from available OBD-II data at the time of the scan. They do not certify a vehicle as good, roadworthy, or free of defects, and cannot detect every problem. Cleared codes and incomplete readiness monitors can hide faults. Always obtain a professional inspection before purchasing.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, VEHICLE DAMAGE, PERSONAL INJURY, OR ECONOMIC LOSS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY RELIANCE ON DIAGNOSTIC INFORMATION, OR ANY REPAIR, PURCHASE, OR DRIVING DECISION — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) RM50. Nothing in these Terms excludes liability that cannot lawfully be excluded.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your repair, purchase, sale, or driving decisions.
10. Eligibility
The Service is not intended for children and is for users aged 18 or older, or the age of majority in your jurisdiction.
11. Changes
We may update the Service and these Terms. Material changes will be posted here with a revised date; continued use means acceptance.
12. Governing law
These Terms are governed by the laws of Malaysia, and you submit to the exclusive jurisdiction of the courts of Malaysia, without regard to conflict-of-laws rules.
